ORDINANCE

CITY OF MONROE No. 11,820
The following ordinance was introduced by Mr. Wilson Who moved for its adoption and was seconded by Ms. Woods :
AN ORDINANCE AUTHORIZING JAMES E. MAYO, MAYOR, TO ENTER INTO A UTILITY EASEMENT AGREEMENT WITH TIMOTHY TODD AND FURTHER PROVIDING WITH RESPECT THERETO.
WHEREAS, Timothy Todd, a property owner located at 1508 N. 6th Street recently completed a small parking area on his property without knowing that the paved area was partially placed on City of Monroe right of way; and
WHEREAS, Mr. Todd’s property was sub divided from an existing lot prior to zoning being in place and there is not enough area on the lot for off-street parking; and
WHEREAS, because of the peculiar nature of the lot the City of Monroe is willing to grant Mr. Todd and any future owner a Utility Easement Agreement for the construction of a paved off-street parking area as per the attached Exhibit “A” and the provisions contained in the Utility Easement Agreement.
NOW, THEREFORE BE IT ORDAINED by the City Council of the City of Monroe, Louisiana, in legal session convened, that we do hereby authorize James E. Mayo to enter into the attached Utility Easement Agreement with Timothy Todd and any future owner under the terms and conditions of the proposed agreement, a copy of which is attached hereto and made a part hereof. Subject to approval by the Board of Adjustments and the Heritage Preservation Commission.

NOTICE PUBLISHED on the 12th day of January , 2018.
This Ordinance having been submitted in writing, introduced and published, was then submitted to a vote as a whole, the vote thereon being as follows:
AYES: Echols, Ezernack, Woods & Wilson
NAYS: None.
ABSENT: Clark (left meeting early)
And the Ordinance was declared ADOPTED on the 22nd day of January , 2018.
